Temporary Partial Disability
At The Davis Law Group, P.C., our attorneys will determine whether you are entitled to temporary partial disability (“TPD”) benefits. If your injury occurred on or after February 1, 2006 and you are on light duty due to your healing injury, you will be entitled to these benefits. You will also be entitled to these benefits if you are working part-time or full-time and earning less than you were earning before your injury. These benefits will be paid until you can return to normal employment or until you reach “maximum medical improvement.”
If your injury occurred before June 28, 2011, you are entitled to two-thirds of the difference between your average weekly wage pre-injury and the net amount you are earning on light-duty. If your injury occurred after June 28, 2011, the difference between your average weekly wage pre-injury and the gross amount you are earning on your light-duty job is calculated, subject to minimum and maximum amounts set by the Commission. You will be entitled to two-thirds of that amount, which are again subject to minimum and maximum amounts set by the Commission.
